Depraved Indifference Law and Legal Definition: To constitute depraved indifference, the defendant’s conduct must be ‘so wanton, so deficient in a moral sense of concern, so lacking in regard for the life or lives of others, and so blameworthy as to warrant the same criminal liability as that which the law imposes upon a person who intentionally causes a crime. Depraved indifference focuses on the risk created by the defendant’s conduct, not the injuries actually resulting.

Quotes of the Day:

“I think probably the most important thing we can really do in my mind, after giving this a lot of thought, is really commit to teaching people about the African American experience in this country,” Kerr said Tuesday on a conference call with reporters. “And I’m not talking about the homogenized one that we all learned in American history and high school. “We need to learn about the real American history, the one that tells the truth about some of the awfulness to it. We’ve got to be able to come to grips with it before we can do anything about it. That sort of reconciliation with the sins of our past is a crucial part of all of this.”   “I think probably the most important thing we can really do in my mind, after giving this a lot of thought, is really commit to teaching people about the African American experience in this country,” Kerr said Tuesday on a conference call with reporters.  “And I’m not talking about the homogenized one that we all learned in American history and high school. Kerr believes that, by changing what children and teenagers are taught, the U.S. will have a better chance at shifting how people view the African American experience. This builds empathy and, ultimately, raises the odds of legislation and reform that will prevent deaths like the one Floyd endured as a Minneapolis police officer knelt on his neck for nearly nine minutes.   “It’s hard for all of us to really come to grips with what we’ve put the African American communities through over the course of American history,” Kerr said. “Most people really don’t know.   I know my education excluded so much of that, so I would like to think that we could make a really concerted effort to learn more about that in order to make some strides socially and politically.” Kerr went on to to discuss how former 49ers quarterback Colin Kaepernick’s 2016 decision to kneel during the national anthem as a silent protest against police brutality soon will be recognized as a key moment in the country’s conversation on race.    “We need to learn about the real American history, the one that tells the truth about some of the awfulness to it. We’ve got to be able to come to grips with it before we can do anything about it. That sort of reconciliation with the sins of our past is a crucial part of all of this.” — Warriors’ Steve Kerr: U.S. Must Commit to Teaching African American Experience

Another timely example of how the Fed is exacerbating wealth inequality in the United States is the hundreds of billions of dollars in repo loans it is making weekly to Wall Street trading firms at the unheard of interest rate of 1/10th of one percent. This rate has been in effect for these loans since the middle of March. These firms could do nothing more complicated than re-loan this money out as margin loans to hedge fund traders and make effortless, windfall profits. But struggling consumers are still being forced to pay the bank parents of these trading firms upwards of 17 percent interest or more on their credit cards. Why isn’t Jerome Powell using his bully pulpit to call for banks to pass along their savings on borrowing costs from the Fed by lowering credit card rates to consumers? Why has the Fed loaned out more than $9 trillion cumulatively since September 19, 2019 to these Wall Street trading houses while the country is still waiting for the first loan to be made by the Fed to the Main Street Lending Facility? — Fed Chair Powell Attempts to Blame U.S. Inequality on Globalization – Gets Smacked Down by Bloomberg Reporter

United States:

The United States is not a Democracy (A government in which the supreme power is vested in the people and exercised by them directly)! Only the 1%, through their ownership of the Reublicrats and who profit from war and the war budget, vote for War and the war budget — A policy, which Gore Vidal called a  Perpetual War for Perpetual Peace. — The 99% Should Decide On War — Not Just The 1% Who Profit From War!  Under a Democracy, The 99% would have the right to vote on the policy of Perpetual War for Perpetual Peace! Slumlord Capitalism v. Global Pandemic The poet Langston Hughes once wrote, “I wish the rent was heaven sent.” With 10 million Americans filing for unemployment benefits in the midst of the coronavirus pandemic, Hughes’ words resonate now more than ever. As we hurtle toward a public health and economic catastrophe, we must reckon with the sobering fact that our federal government is helmed by landlords, real estate developers, and financiers whose fortunes have been made – and whose worldview has been shaped – by years of predatory and extractive business practices. These practices prefigured the federal response to the pandemic and overdetermine the nature of the state-led economic rescue that is already underway. By John WhitlowTrump and Republicans Attack Black Voting Rights, As Mass Upsurge Fights Black Oppression Recent polls suggest US President Donald Trump may lose the November 2020 election and the Republican Party its majority in the Senate.  Trump’s deliberate failure to confront the COVID-19 pandemic, which has deepened the economic recession (a result that caught Trump unawares) and his championing of a violent smashing of the current uprising have contributed to the poll results.  The Republicans know that, as in 2016, Trump is likely to lose the popular vote, but could win the anti-democratic Electoral College vote. Therefore, they are concentrating on winning the vote in states where results will be close. One tactic the Republicans are using in those states where they control the government, is to curtail African Americans’ right to vote, because the great majority do not vote  By Barry Sheppard Trump’s Illegal Use of Military Against Anti-Racist Uprisings Portends Battles Ahead The backlash against Donald Trump’s illegal show of military force against anti-racist protesters compelled him to withdraw the troops — for now. But we must continue raising the illegality of this use of the military and pushing for barriers to guard against future such deployments. The threat of a resurgence of this violation still looms because as the protests continue, Trump might change his mind. And if he loses the election, all bets are off.Government officials, legislators, lawyers and civil society should strenuously oppose the recall of federal troops because it would be deadly as well as illegal. “Armed forces taking on protesters may cause them to go away, but make no mistake: People would die. And even one more death is too many,” Kelsey Baker, a former Marine who deployed to Kuwait and Iraq, wrote for Newsweek. By Marjorie Cohn Environment:

A Test Case in Sustainable Farming: In a recently published study, we show that Cuban rivers are cleaner than the mighty Mississippi. Why? Because Cuban farmers practice organic farming and conservation agriculture to reduce soil erosion and nutrient loss.    In sum, Cuba is doing a better job than the U.S. at keeping farming from hurting its rivers, and its results offer useful lessons.    Cuban rivers run from the mountains to the ocean through cow-filled pastures, fields of sugar cane and rice paddies, forests, wetlands and mangroves. Along the way, groundwater seeps into river channels from below. When heavy thunderstorms strike, water pours off the land.   These flows carry soil and dissolved material into streams, which deliver this load to the coast. Cuba’s coastlines have abundant mangrove thickets, underwater seagrass beds and some of the Caribbean’s best-preserved coral reefs. — The US Has Much to Gain From Increasing Scientific Cooperation With Cuba

Atlanta Police Shoot and Kill Rayshard Brooks as Protests Demanding Racial Justice Continue WorldwideWhen Castro was up in the mountains of Cuba they told him the odds were against him. Today he’s sitting in Havana and all the power this country has can’t remove him. They told the Algerians the same thing–what do you have to fight with? Today they have to bow down to Ben Bella. He came out of the jail that they put him in and today they have to negotiate with him because he knew that the one thing he had on his side was truth and time. Time is on the side of the oppressed today. It’s against the oppressor. Truth is on the side of the oppressed today, it’s against the oppressor. You don’t need anything else. I would just like to say this in my conclusion. You’ll see terrorism that will terrify you, and if you don’t think you’ll see it, you’re trying to blind yourself to the historic development of everything that’s taking place on this earth today. You’ll see other things. Because as soon as people realize that it’s impossible for a chicken to produce a duck egg even though they both belong to the same family of fowl–a chicken just doesn’t have within its system to produce a duck egg. It can’t do it. It can only produce according to what that particular system was constructed to produce. The system in this country cannot produce freedom for an Afro-American. It is impossible for this system, this economic system, this political system, this social system, this system, period. It’s impossible for this system as it stands to produce freedom right now for the Black man in this country. And if ever a chicken did produce a duck egg, I’m certain you would say it was certainly a revolutionary chicken!— Malcolm X,  Militant Labor Forum in New York on March 29, 1964

Labor:

Cops Are Not By ‘Brothers’!:   In the wake of the police murder of Michael Brown in Ferguson, Missouri, Trumka made this remarkable statement: “Lesley McSpadden, Michael Brown’s mother who works in a grocery store, is our sister, an AFL-CIO union member, and Darren Wilson, the officer who killed Michael Brown, is a union member, too, and he is our brother.”    We cannot prevent cops from having their own organizations. But we can demand that they not be given sanction by our labor spokespersons and their unions. We can demand that police be outside the purview of labor laws meant to protect workers, not murderers and torturers (not too strong a word for the notorious Chicago Police Department and many others). Because make no mistake about it, the police are our enemy. We must have entirely different conceptions of public safety, as well as prisons and justice. The more radical our demands, the better. We live in a sick, depraved system. Destroy it root and branch, as we learn to care for ourselves, collectively and democratically. We owe this, at the least, to the memory of the myriad struggles of Black, Hispanic, Native American, and all the workers who fought so bravely to turn the tide against police brutality and the depredations that are the daily lives of all who live under capital’s yoke. — Police are the Enemy Within

Wall Street Banks Tank One Day After Fed Chair Says They’re “a Source of Strength” Every major Wall Street bank tanked yesterday. Citigroup fared the worst, losing 13.37 percent of its market value versus a broader market decline of 5.89 percent on the S&P 500 Index. Bank of America didn’t look like much of a source of strength either, losing 10.04 percent on the day. The largest bank in the country, JPMorgan Chase, whose CEO, Jamie Dimon, perpetually brags about its “fortress balance sheet,” lost 8.34 percent. For a close look at what’s hiding in the tall weeds behind that fortress, see here. Just the afternoon before this bank carnage, this is what the Chairman of the Federal Reserve, Jerome Powell, had to say in his press conference about the U.S. banking system (which, of course, the Fed has been in charge of supervising in order to prevent another catastrophic blowup as occurred in 2008):By Pam Martens and Russ MartensWorld:

Health, Science, Education, and Welfare:

The government of the United States can pass laws in a few days to spend tens of trillions of dollars for war and the bailout of Wall Street and the bankers. Yet, those who ‘governn’, pass universal healthcare for themselves, but they cannot spend even one trillion dollars for universal health for those who are ‘governed’! This is what is considered, by the powers to be,  a democracy and part of the democratic way. — Roland Sheppard, Let the People  Vote on Healthcare

As the COVID-19 pandemic sweeps around the world, scientific cooperation is more important than ever. To us, it doesn’t make sense to increase sanctions against a country that has more doctors per capita than any country on Earth and has responded more successfully than many nations to COVID-19. We believe that science in the U.S. would gain from reopening communication with Cuba and sharing knowledge that could help heal the global community. — The US Has Much to Gain From Increasing Scientific Cooperation With Cuba

Biomodulin T isNot Available in the USA Due to the Blockade:              Cuba Uses Biomodulin T to Prevent COVID-19 in the Elderly About 500 people living in nursing homes have received this Cuban medicine to increase their defenses. In the fight against COVID-19, Cuba is implementing drug-based protocols developed for other pathologies, one of which uses Biomodulin T, a drug originally produced to treat chronic obstructive pulmonary disease in the elderly.  The Center for Research on Longevity, Aging, and Health (CITED) Director Liliam Rodriguez reported that Biomodulin T has been used to protect the elderly living in public centers since mid-April. After a month, this preventive measure has been completely successful since no patient treated with Biomodulin T has contracted COVID-19. This treatment has also been accompanied by strict security measures implemented in nursing homes. “At the working meeting with President Miguel Diaz-Canel, we presented the results of Biomodulin T used in all nursing homes… What a joy to know that another Cuban medicine helps save lives,” BioCubaFarma President Eduardo Martinez said.
