From Laura Chapman: The Espinoza Decision Was a Farce, Because It Was Moot!: The majority decision said that if a state offers a scholarship program for private schools, it must include religious schools. The dissenters, Chapman noted, pointed out that the Montana Supreme Court had already invalidated the private scholarship program. So the case was already moot because Montana no longer has a scholarship program for private schools! The Espinoza family will not get $150 (the amount that used to be paid to families that sought help in paying private school tuition) because Montana no longer offers scholarships to private schools, and thus will not be affected by today’s decision! . . . Judge Sotomayor, J., filed a dissenting opinion. The majority holds that a Montana scholarship program unlawfully discriminated against religious schools by excluding them from a tax benefit. The threshold problem, however, is that such tax benefits no longer exist for anyone in the State. The Montana Supreme Court invalidated the program on state-law grounds, thereby foreclosing the as-applied challenge petitioners raise here.Indeed, nothing required the state court to uphold the program or the state legislature to maintain it. The Court nevertheless reframes the case and appears to ask whether a longstanding Montana constitutional provision is facially invalid under the Free Exercise Clause, even though petitioners disavowed bringing such a claim. But by resolving a constitutional question not presented, the Court fails to heed Article III principles older than the Religion Clause it expounds.

Fauci Is “Very Concerned” US COVID Cases May “Go up to 100,000 a Day” Anthony Fauci, director of the National Institute of Allergy and Infectious Diseases and a member of President Donald Trump’s coronavirus task force team, gave a grim assessment of where things could be headed with regard to the total number of new cases of COVID-19 infections seen daily in the United States. The country is “going in the wrong direction” in terms of controlling the spread of COVID-19, Fauci said, while testifying before the Senate Health, Education, Labor and Pensions Committee. De-Militarizing the United States More than a half-century ago, exactly one year before he was assassinated, Martin Luther King Jr. brilliantly identified the keys to the American political, economic, and social crisis that has worsened over the years. At the Riverside Church in New York City, King linked the militarism of the Vietnam War; the racism of American society; and the inequality and materialism of the American economy to demand a movement toward social justice that we seek today. The central civil rights leaders of the time, including Ralph Bunch, asked King to radically alter the speech and to dissociate racism from the Vietnam War. The central newspapers of the time, including the New York Times and the Washington Post, maligned the speech, terming it an “oversimplification” that would hurt both the civil rights movement and the anti-war movement. On the Ground at Abolition Park: Demonstrators Vote To Stay after City Council Passes Disastrous Budget After the NYC City Council failed to cut the NYPD by even $1 billion, activists at the City Hall Encampment voted to remain in the space. Police tried to evict them Wednesday morning, but the encampment held strong. In the first minutes of Wednesday morning, the City Council of New York voted on a pro-cop budget attacking working class and oppressed people. While Mayor de Blasio claimed that the budget defunded the NYPD by $1 billion, it did no such thing. Instead, it cut social services and education and opened the door to thousands of people getting laid off.
The Pandemic and Wealth Inequality The latest figures from the Federal Reserve Board on wealth inequality cover through the quarter ending in March 2020. They show a reduction in wealth inequality—something that has happened during economic downturns. More importantly, according to the Fed, wealth inequality has generally been increasing since the first covered period, the third quarter of 1989 to when it reached its highest level in the fourth quarter of 2019 during the Trump regime. Southeast Asia — Polution Dumping Ground: Capitalism Fouls Thing Up: Tonnes of ‘Recycled’ European Plastic Pollutes the Oceans Researchers find that much supposedly recycled plastic from Europe is in fact exported to Southeast Asia and dumped Researchers from National University of Ireland Galway and the University of Limerick have concluded that “Recycling of European plastic is a pathway for plastic debris in the ocean.” That’s the title of a study published this week in the journal Environment International, showing that much of the plastic supposedly recycled by the EU, UK, Switzerland and Norway actually ends up in the ocean.

Advocates estimate that hundreds of asylum seekers, many of whom arrived in Canada via the United States since 2017, are working in long-term care homes and elderly residences for low pay and at great personal risk. Powell and Mnuchin Agree to Work with a Proposed “Department of Reconciliation” to Deal with Effects of Slavery and Segregation Fed Chairman Jerome Powell and Treasury Secretary Steve Mnuchin apparently fear unleashing more angry protesters across the country screaming “no justice, no peace” into an air increasingly filled with COVID-19 droplets, more than they fear Trump Tweeting reprisals against them in the wee hours of the morning. Both Powell and Mnuchin raised their hands yesterday during the House Financial Services Committee hearing to agree to work with a proposed Department of Reconciliation to deal with the country’s history of slavery, segregation and ongoing “invidious discrimination” of people of color. Opus Dei’s Influence on the U.S. Judiciary “Leonard Leo can take credit for installing four Supreme Court justices” – John Roberts, Samuel Alito, Neil Gorsuch and Brett Kavanaugh. “As executive vice president of the Federalist Society, Leo has been the quiet architect of a pivotal shift to the right throughout the federal judiciary” including “dozens of lower court federal judges across the country.” It was Leo who prepared Trump’s “list of judges and the people that he’s put on the bench.” Leo is on the board of directors of Opus Dei’s Catholic Information Center located at 15th and K Street, two blocks from the White House. The Center is “a rallying point for ultra-conservative Catholics eager for a voice in the secular halls of government power” and “advances a hard-right political agenda,” according to Church and State, Americans United for Separation of Church and State’s magazine. California Charter Schools Collect Millions Intended for Small Businesses The Network for Public Education has been tracking the charter schools that collected from the federal Paycheck Protectiin Program intended to help small businesses struggling to survive. The charter schools have not had any budget cuts, have lost no money, have not been struggling to pay employees, but their lobbyists get them included as eligible for the PPP funding, although public schools are not eligible.
